Know Your Rights

Weingarten Rights

Weingarten rights are unionized employees'' rights to have a union representative present for any investigatory interview conducted by the employer, in which the employee has a reasonable belief that the discussion could lead to disciplinary action.

What Employers Can’t Do

Federal law protects your right to organize a union, speak up about working conditions, and stand together with your coworkers. Employers are not allowed to:

  • Threaten, fire, demote, or discipline you for union activity
     
  • Spy on union meetings or ask workers about their union support
     
  • Offer raises, promotions, or special treatment to discourage union support
     
  • Interfere with or delay union organizing efforts
     
  • Retaliate against you for filing grievances or reporting unsafe or unfair practices
     

If any of this happens at your job, contact your steward immediately. These are serious violations of your legal rights under the National Labor Relations Act (NLRA).
